Business & Corporate Law

Padula & Grant has extensive experience with various matters relating to business and commercial law, including business and commercial litigation, contracts and breach of contract, and corporate law.  We provide comprehensive business representation, from selecting the appropriate form of entity for a new business venture, preparing and filing the appropriate documents to form your new business entity, drafting lease agreements, and negotiating and drafting your contracts.  In the business and commercial setting, disputes often arise, and our attorneys are also experienced in representing businesses in litigation involving breach of contract disputes; we act as trusted advisors for all of our business clients' needs. 

Additionally, because we are highly experienced in both trial litigation and alternative dispute resolution methods such as arbitration and mediation, we provide our business clients with a variety of options to resolve disputes efficiently and cost-effectively. 

Employment

Our attorneys represent clients in a variety of employment-related legal matters pursuant to the Federal Fair Labor Standards Act, which governs unpaid overtime claims, minimum wage violations, and child labor laws.   Our extensive experience representing both plaintiff employees and defendant employers under these laws ensures that we understand both sides of the issues and can provide our clients with effective and objective representation. 

Landlord/Tenant & Condominium Law

Florida is one of the few states that have a Condominium Act, which governs a variety of aspects of condominium-related issues, including owners' associations, types of condominiums, and issues related to sale of condos.  This area of law is unique to geographic locations such as Boca Raton, Florida that have a large vacation condominium community.  Therefore, if you are a condominium association or owner and have a dispute, you need a local attorney who is experienced in this unique area of law as the laws in this area are frequently subject to change.

Condominium and Homeowner associations are unique types of non-profit businesses involving complex legal situations every day.  Association members have both property rights and community obligations, and balancing these rights and interests can be a delicate process.  We have experience representing both homeowners and associations with a variety of legal issues, including drafting and enforcing by-laws, covenant enforcement, management issues, collection of delinquent fees, and construction defect disputes.  While we primarily litigate on behalf of homeowners, we also counsel both Associations and homeowners regarding the application of state and local law.  Additionally, we are committed to staying up-to-date on court rulings and administrative decisions, which can impact the operation of community associations and their homeowners.  We can also assist you when dealing with the state's Division of Florida Condominiums, Timeshares, and Mobile Homes.

Additionally, we have extensive experience in traditional landlord-tenant issues, representing both landlords and tenants in both residential and commercial properties in all aspects of the landlord-tenant relationship.  We assist our clients throughout the process, from creating lease agreements to terminating such agreements, including eviction and wrongful eviction proceedings, general disputes, breach of lease, non-payment of rent, landlord liability, and deposit return matters. 

Construction Litigation

Padula & Grant represents clients in a variety of construction law related issues.  Primarily, we handle construction liens, payment and performance bond claims, and construction defect claims and defense.  Because we are experienced trial litigators who also have significant experience utilizing alternative dispute resolution methods such as arbitration and mediation, we can advise our clients on the most effective and cost-efficient course of action for a specific case following a careful analysis of the facts. 

In addition to representing clients in construction disputes, we assist our construction clients with preparing, reviewing, and negotiating various types of construction-related contracts.

Estate Litigation

The attorneys of Padula & Grant represent beneficiary and personal representative clients in a variety of estate and probate litigation matters, including will contests, trust disputes, breach of fiduciary duty, and allegations of undue influence.  Our attorneys also provide experienced representation of trustees, executors, administrators, agents and other fiduciaries.  Additionally, we have experience assisting our clients in probate administration matters.
